New Financial Institutions Language for Living Trust

For years, we have been at odds with the banking and other financial institutions over the use of the Financial Powers of Attorney. The issue occurs when the principal (you) cannot handle financial matters (normal banking transactions, movement from one account to another, maturing CDs) and your designated agent under your Financial Powers of Attorney needs to operate in your place. Banks and other financial institutions have been refusing to allow your agent to transfer trust named assets (like a CD) to a non-trust named asset (like your daily used checking account). With the new Financial Institutions language placed in your living trust, you will now have the written authority to appoint an agent to handle your trust assets. With an update to both your living trust and Financial Powers of Attorney with the new Financial Institutions language, your agent will be able to transact your financial business in a time of need as intended.
